Abstract
Il presente contributo si propone di offrire nuovi spunti di indagine sul problema – che affligge principalmente l’Italia rispetto a tutti gli altri Paesi europei – della (ir)ragionevole durata del processo, con l’obiettivo di suggerire, in attesa di una riforma organica del rito civile, interventi immediati e sostenibili che garantiscano concretamente di poter raggiungere, nel breve periodo, risultati accettabili in termini di rapidità ed efficienza, senza sacrificare la “ponderatezza” della decisione, da intendersi quale valore imprescindibile a cui mira l’iter processuale.
This work offers new insights into the problem – which mainly affects Italy compared to all other European countries – of the (ir)reasonable duration of the process, with the aim of suggesting, pending an organic reform of the civil rite, actions that will ensure concretely to achieve, in the short term, acceptable results in terms of speed and efficiency, without sacrificing the “pondering” of the decision, which is understood as an essential value of the process.
