La full jurisdiction nella giurisprudenza nazionale. Un quadro complesso in evoluzione

Abstract

Questo contributo si prefigge di cogliere la linea evolutiva della giurisprudenza nel senso della lenta ma progressiva affermazione del sindacato quantomeno sulle valutazioni tecniche della Pubblica amministrazione. Si parte dalla presa d’atto delle molteplici norme contenute nel codice del processo amministrativo, peraltro ormai non più di recente conio, che denotano la crescente attenzione del legislatore nei riguardi dell’intensità del sindacato del giudice amministrativo, sia pure con la contestuale riaffermazione, anche in sede correttiva, della cd. riserva di amministrazione. Di qui la necessità di risolvere tale apparente antinomia attraverso la ricerca del crinale che separa un giudice giustamente consapevole del proprio ruolo da uno invece incline a penetrare indebitamente nei gangli dell’agere amministrativo. L’ontologica differenza, che resiste tuttora, tra Autorità amministrativa e giurisdizionale non consente quindi, al momento, di accedere ad un sindacato pieno dei fatti di causa che preluda alla sostituzione dell’Amministrazione ad opera del giudice, ma questo non dovrebbe valere anche per le valutazioni tecniche, stante la generalizzata facoltà di ricorrere allo strumento istruttorio della C.T.U. La giurisprudenza ha quindi intrapreso un faticoso e tormentato percorso che ha condotto alla stessa ridefinizione delle nozioni di discrezionalità amministrativa e tecnica per implementare l’intensità del sindacato giudiziale quantomeno in sede di esercizio di discrezionalità tecnica. La giurisprudenza amministrativa ha trovato un valido supporto nella Suprema Corte, che, chiamata ad espletare il controllo sulle sentenze del Consiglio di Stato per difetto di giurisdizione, ai sensi dell’art. 110 del C.P.A., sta assumendo posizioni sempre più meditate e bilanciate rispetto alla specificità che presenta ciascuna controversia. Non si tratta quindi di distinguere tra un sindacato “forte o debole” quanto di rintracciare, volta per volta, quei confini che ancora oggi delimitano le competenze giurisdizionali da quelle propriamente amministrative. Poiché il traguardo è ancora lontano si è tentato di formulare alcuna considerazioni che consentano di tranquillizzare il giudice in queste operazioni di scrematura da vecchi retaggi culturali. Si è quindi rilevato, aggiornato lo stesso concetto di interesse pubblico, che l’ordinamento sembra spingere, sia pure in maniera rapsodica e disorganica, verso un nuovo giudice amministrativo che, chiamato ad intervenire a seguito di una class action o in nome di esigenze ispirate dal principio di proporzionalità, può conoscere la vicenda senza limiti precostituiti per sindacare finalmente le scelte dell’Amministrazione. In tutto questo un ruolo non significativo svolge il diritto europeo, vero volano di una metamorfosi culturale prima che giuridica che avvicina sempre più i sistemi giuridici di civil law a quelli di common law per addivenire ad un ordinamento unitario sì ma armonico ed equilibrato. La crescente sensibilità della giurisprudenza verso i valori europei trova riscontro in sempre più numerose pronunce sia dei giudici amministrativi che delle stesse Sezioni Unite, ma le caratteristiche peculiari del nostro ordinamento, soprattutto nel settore del diritto pubblico, devono indurre a rinvenire in esso le ragioni di quella che appare una svolta ormai necessaria ed ineludibile.

 

This paper aims to grasp the evolutionary line of jurisprudence in the sense of the slow but progressive confirmation of the union on the technical evaluations of the Public Administration. It is the taking charge of the laws in the administrative process, moreover not more recent, which denote the increasing attention of the legislator in relation to the intensity of the union, even in the reaffirmation, even in a corrective, of the so-called. reserve of administration. Hence the need to resolve the apparent antinomy story through the search for the ridge that separates a judge rightly aware of his role from one instead inclined to penetrate unduly into the ganglia of administrative action. The ontological difference, which still resists, between authority and jurisdiction is therefore not, at the moment, in front of a full union of lawsuit that leads to the substitution of the administration by the judge, but this should not also apply to the technical assessments, given the generalized right to resort to the investigative tool of the CTU. The jurisprudence then embarked on a tiring and tormented path that led to the same redefinition of the notions of administrative and technical discretion to implement the influence of the judicial union at least in the exercise of technical discretion. The administrative jurisprudence has found a valid support in the Supreme Court, which, for example, has control over the decisions of the Council of State by jurisdiction, pursuant to art. 110 of the Italian Code of the Administrative Process, is taking increasingly more meditated and balanced positions with respect to the specificity that each dispute presents. It is not a matter of distinguishing between a "strong or weak" trade union or of tracing, at a time, those boundaries that still today limit jurisdictional competences from those that are properly administrative. Because the goal is still far away, it has been considered in those skimming operations from old cultural heritage. What has been thought, updated in the same way of public interest, which is the order to push, both pure rhapsodic and inorganic, towards a new administrative judge that, as if to intervene following a class action or in the name of needs inspired by the principle of proportionality, can know the story without preconceived limits to finally unify the choices of the Administration. European law, the real driving force of a cultural metamorphosis before the juridical one that more and more the legal systems of civil law to those of common law to achieve a unitary but harmonious and balanced order. The growing sensitivity of jurisprudence towards values is reflected in more and more pronunciations both of administrative judges and of the same United Sections, but the peculiar characteristics of our legal system, in the field of public law, must induce a finding in it the reasons for what a turning point is now necessary and unavoidable.
