Abstract

[The particularly vulnerable victims’ testimony in the light of directive
2012/29/EU] The particularly vulnerable victim called to witness has been
regulated in the code of criminal procedure by legislative decree no. 212/2015 which has transposed directive 2012/29/EU. The Author analyses this category of people and then he studies the protective measures when this type of victim takes on the role of “acquainted with the facts” or witness. He also highlights the most relevant questions, caused by the wording of European directive or by negligence in its national transposition. Finally the Author remarks that the legislator has frequently reformed the testimony of “weak” people, but there is a fundamental problem, which has never been solved (on the contrary, it has been exacerbated): the lack of coherence in the rules of the code.
