Abstract
L’autore analizza, nei suoi aspetti squisitamente giuridici, gli obblighi del datore di lavoro connessi alla valutazione di tutti i rischi per la sicurezza e la salute dei lavoratori nonché alla redazione del relativo Documento di Valutazione, espressamente previsto dagli artt. 28 e 29 del decreto legislativo 9 aprile 2008, n. 81, e successive modificazioni. La disamina prende le mosse dall’evoluzione storica della normativa in materia, mettendo in risalto la ratio che ha condotto il legislatore a prevedere tali obblighi, nonché la loro natura ed il loro specifico contenuto. Analizza anche la natura giuridica, la funzione e il contenuto del Documento unico di valutazione dei rischi da interferenze (DUVRI) nonché la possibilità per il datore di lavoro di ricorrere all'autocertificazione o alle procedure standardizzate, anche alla luce dei recenti sviluppi legislativi.
The author analyzes, in its purely legal aspects, the obligations of the employer related to the assessment of all the risks to workers’ safety and health and to the drawing of the relative Assessment Document, expressly provided by art. 28 and 29 of Legislative Decree 9 April 2008, No. 81 and subsequent amendments. The examination starts form historical developments of the regulation in this matter, highlighting the reason why legislator imposed this obligation, its nature and specific content. The author also analyzes the legal nature, the function and content of the Single Document of Assessment of Interference Risks (Documento Unico di Valutazione dei Rischi da Inteferenze - DUVRI) and the possibility for the employer of using self-certification and standardized procedures, also considering the recent legislative developments.
