La sicurezza del lavoro nell’ordinamento europeo

Abstract

L’autore analizza l’evoluzione della disciplina di tutela della salute e sicurezza dei lavoratori nell’ordinamento europeo a partire dai Trattati Ceca ed Euratom e dai primi programmi di azione sociale, approfondendo in particolare i contenuti della direttiva quadro n. 89/391/Cee (definizioni, ambiti di applicazione, obblighi, responsabilità, diritti di informazione e consultazione, modelli di rappresentanza) e delle principali “direttive particolari”, tra cui anche la direttiva n. 93/104/Cee in materia di regolamentazione degli orari di lavoro. Una speciale attenzione è dedicata al rilevante contributo che le pronunce della Corte di Giustizia hanno dato alla corretta interpretazione del diritto sociale comunitario e alla sua efficace attuazione negli ordinamenti degli stati membri. Il saggio termina con una riflessione sulle più recenti strategie comunitarie in materia di salute e sicurezza dei lavoratori, nelle quali si evidenzia l’utilità di integrare i tradizionali strumenti giuridici con misure di “soft law”, di cui fanno parte anche gli accordi collettivi europei in tema di telelavoro, stress lavoro-correlato, molestie e violenze.


The author analyzes the evolution of the discipline of health and safety of workers into the European law, starting from the Ceca and Euratom Treaties and from the first social action programs, especially focusing on the content of the Framework Directive 89/391/EEC (definitions, application, obligations, responsibilities, rights to information and consultation, models of representation) and some “specific directives”, including the directive 93/104/EC concernig certain aspects of the organization of working time. A special attention is paid to the significant contribution that the judgments of the Court of Justice have given to the correct interpretation of Community social law and to its effective implementation in the Member States. The essay concludes with a reflection on the most recent EU strategies on health and safety of workers, in which are underlined the usefulness of integrating the  traditional legal instruments with measures of "soft law", which include also European collective agreements regulating teleworking, work-related stress, harassment and violence.
