La sicurezza sul lavoro nei porti

Abstract

Obiettivo del saggio è quello di fornire un contributo allo studio della disciplina della sicurezza sul lavoro in un settore di strategica importanza nazionale, quale quello portuale. A tal fine, il saggio, partendo da un’analisi generale delle peculiarità che caratterizzano tuttora il lavoro portuale, si concentra sulle interazioni sussistenti tra il d.lgs. 9 aprile 2008, n. 81 e la normativa specifica in materia di sicurezza e salute dei lavoratori portuali contenuta nel d.lgs. 27 luglio 1999, n. 272. L’analisi si concentra, pertanto sui concetti chiave della sicurezza con la specificazione delle tipologie di rischio del settore, individuando i soggetti della sicurezza e i relativi compiti e competenze. In chiusura, il saggio affronta le tematiche della valutazione dei rischi e della dimensione collettiva degli obblighi prevenzionistici nelle loro definizioni e peculiarità.

Aim of the essay is to give a contribution to the study of the occupational health & safety regulation in an area of national strategic importance, i.e. the ports. Therefore, the paper, starting from a general analysis of the peculiarities that still characterize the port work, focuses on the interactions that exist among the Legislative Decree 9th April 2008, n. 81 and the specific legislation on health & safety of the port workers established in the Legislative Decree 27th July 1999, n. 272. The analysis focuses, therefore, on the key concepts of the health & safety with the specification of the types of risks in the sector, identifying the players of the health & safety and their tasks and responsibilities. In closing, the paper addresses the issues of risks assessment and the collective dimension of the preventive obligations in their definitions and characteristics.
