Abstract
Il saggio intende fornire un contributo allo studio della figura del datore di lavoro, utilizzando come punto di osservazione il microsistema della salute e sicurezza sul lavoro, in quanto recentemente oggetto di importanti novità legislative. In particolare, si è inteso verificare se, ed in che termini, la configurazione dell’obbligo di sicurezza, e la connessa specificità della disciplina dettata in materia, si rifletta sulle categorie fondanti del diritto del lavoro, con specifico riferimento all’individuazione della figura datoriale ed ai poteri dalla stessa esercitati.
The essay is intended to provide a contribution to the study of the figure of the employer, using as point of view the microsystem of health and safety at work that has recently undergone important changes in legislation. In particular, it was intended to check whether, and in which terms, the configuration of the safety obligation, and the connected specificity of the rules laid down on this matter, is reflected in the categories which are the foundations of the labor law, with particular attention to identify the figure of the employer and the powers exercised by the same.
